These Terms of Service ("Terms") constitute a legally binding agreement between you and Escape Tech Enterprises, Inc., doing business as Body Fitness AI ("Body Fitness AI," "we," "us," or "our"). By accessing or using our Service, you agree to be bound by these Terms.

By creating an account, accessing, or using Body Fitness AI, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must immediately discontinue use of the Service.

2. Eligibility and Geographic Restrictions

To use Body Fitness AI, you must meet all of the following eligibility requirements:

• You must be at least 18 years old
• You must be a resident of the United States or Canada
• You must have the legal capacity to enter into a binding agreement

Geographic Restrictions: This Service is not available to residents of the European Economic Area (EEA), United Kingdom, or other jurisdictions with strict data localization requirements. By using this Service, you represent and warrant that you meet all eligibility requirements and are not accessing the Service from a restricted jurisdiction.

We do not knowingly collect information from anyone under 18 or from individuals in restricted jurisdictions. If we become aware that we have collected information from such individuals, we will delete it promptly.

3. Service Description

Body Fitness AI provides AI-powered fitness coaching through a web-based application. Our Service includes:

• Personalized workout programming
• Real-time exercise guidance and form cues
• AI-driven coaching adaptations
• Progress tracking and analytics

4. User Accounts

To use our Service, you must create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use
• Providing accurate and complete information

You may not share your account with others or create multiple accounts for the same individual.

5. Subscription & Billing

Body Fitness AI operates on a freemium subscription model with the following terms:

• Free Plan: All users receive a free plan with personalized training plans, workout tracking, set logging, and 30 AI coaching messages per month at no cost
• AI Coaching Usage: AI coaching messages are counted toward your monthly limit (free plan) or are unlimited (Premium plan). The following features always remain free regardless of plan:
  • Personalized training plan generation
  • Workout initialization and set logging
  • Profile setup and updates (goals, equipment, limitations, schedule)
• Premium Subscription: The Premium plan ($9.99/month) provides unlimited AI coaching, exercise swaps, video demos, and analytics
• Auto-Renewal: Subscriptions automatically renew each month unless canceled
• Payment: You authorize us to charge your payment method on file
• Cancellation: You may cancel anytime; access continues until the end of your billing period
• Refund Policy:
  • 7-Day Money-Back Guarantee: Request a full refund within 7 days of your first Premium subscription purchase for any reason, no questions asked
  • Prorated Refunds: Available for significant service outages or technical issues that prevent you from using the Service
  • How to Request: Email jchaney@escapetech.rocks with your account email and reason. We process eligible refunds within 5-7 business days
  • Non-Refundable: Subsequent monthly Premium subscription renewals are non-refundable. The 7-day guarantee applies only to your first Premium subscription purchase
• Free Plan Message Limit: Free plan AI coaching messages reset monthly. When the monthly limit is reached, core features (training plans, workout tracking, set logging) remain available
• Upgrading: Upgrade to Premium at any time for unlimited AI coaching and additional features

6. Health & Liability Disclaimer

IMPORTANT: Physical exercise involves inherent risks.

• Body Fitness AI is NOT a medical professional, licensed physical therapist, or certified personal trainer
• Our AI provides fitness guidance for informational purposes only
• You assume ALL RISK for any physical activity performed
• Consult your physician before starting any exercise program
• Stop immediately if you experience pain, dizziness, or discomfort
• We are NOT liable for any injuries, illnesses, or adverse effects

7. Prohibited Activities

You may not:

• Violate any laws or regulations
• Harass, abuse, or harm others
• Reverse engineer, decompile, or hack the Service
• Scrape data or use automated tools
• Misrepresent your identity or affiliation
• Share your account credentials
• Use the Service for commercial purposes without authorization

8. Intellectual Property

All content, features, and functionality of Body Fitness AI (including but not limited to text, graphics, logos, software, and AI models) are owned by Escape Tech Enterprises, Inc. and protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

We disclaim all warranties, including but not limited to:

• Fitness results or outcomes
• Accuracy or completeness of AI recommendations
• Uninterrupted or error-free service
• Security or privacy of data transmission

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ESCAPE TECH ENTERPRISES, INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES.

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Escape Tech Enterprises, Inc. and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of these Terms.

12. Dispute Resolution

Governing Law: These Terms are governed by the laws of the State of Oregon, without regard to conflict of law principles.

Arbitration: Any dispute arising from these Terms shall be resolved through binding arbitration in accordance with the American Arbitration Association's Commercial Arbitration Rules in Salem, Oregon.

Class Action Waiver: You agree to resolve disputes on an individual basis only. You waive any right to participate in a class action lawsuit or class-wide arbitration.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

14. Termination

We may terminate or suspend your account immediately, without prior notice, for any reason, including violation of these Terms. Upon termination, your right to use the Service will immediately cease.
